Artwork Sales Terms

These Artwork Sales Terms and Conditions (‘Terms’) apply to the purchase of all physical art products sold through our website at www.kapulewis.com, including original artwork, signed limited edition prints, signed artist’s proof prints, hand-embellished prints, mounted and framed prints, greeting cards, and other related physical products (together, ‘Products’).

Please read these Terms carefully before placing an order. By placing an order you confirm that you accept these Terms and agree to be bound by them.

These Terms should be read alongside our other policies which also govern your relationship with us:

  • Website Terms of Use: which govern your use of our website generally.

  • Conduct, Concerns and Complaints Policy: which sets out our standards of conduct and our complaints procedure.

  • Privacy and Cookie Policy: which explains how we collect and use your personal data.

 

These Terms do not apply to the purchase of our creative writing workshops or mentoring services, which are governed by our separate Workshops and Mentoring Terms and Conditions.

1. About Us

Products sold through this Website are sold by FutureSmartMedia Limited trading as Kapu Lewis and Kapulewis.com (‘FSM’, ‘we’, ‘us’, ‘our’), a company registered in England and Wales (Company No. 09555889, VAT No. 280 249 112) of 4 Denbigh Close, London, W11 2QH, United Kingdom.

All artwork sold through this Website is created by Katharine Lewis, trading as Kapu Lewis.

2. Our Products

2.1 Product Categories

We currently sell the following categories of Products through this Website:

  • Signed Artist’s Proof Prints (‘Artist’s Proofs’): unique prints from the artist’s own retained allocation, produced in very small numbers (typically two), hand-embellished with inks or other media by the artist following the printing process, signed and supplied with a Certificate of Authenticity.

  • Signed Limited Edition Prints (‘Limited Prints’): fine art prints produced in a strictly limited numbered edition, signed by the artist and supplied with a Certificate of Authenticity.

  • Greeting Cards: standard printed cards sold in packs, featuring artwork by Kapu Lewis. These are retail printed goods and are not part of any numbered edition.

  • Framed and Mounted Products: any of the above Products may be available for purchase either unframed (with or without mounting) or in a sustainable hardwood frame with glass glazing, as specified on the relevant product page.

 

2.2 Framing

Where a framing option is offered, we use sustainable hardwood frames with glass glazing. We do not use fibreboard or acrylic glazing. Glass glazing maintains its clarity over time and can be safely cleaned. We have successfully shipped framed works containing glass since 2005.

Framing options and dimensions (image size, mounted size, and framed size) are set out on each product page. Please check these carefully before ordering.

2.3 Product Descriptions and Images

We take reasonable care to ensure that product descriptions and images on our Website are accurate. However, the colours and appearance of Products as displayed on your screen may vary from the actual Product due to your device’s display settings.

Where a product page describes a work as part of a literary or artistic series, or refers to associated works, this is provided for context only and does not form part of your contract with us.

3. Artistic Variations and Hand-Embellishment

All of our Products are works of fine art. Due to the nature of fine art production and printing, minor variations may occur between Products and between Products and any image shown on our Website, including in colour, paper texture, ink density, or finish. These variations form part of the artistic character of the work and do not constitute defects.

Artist’s Proofs and some Limited Prints may be individually hand-embellished or hand-finished by the artist following the printing process (for example, with pearlescent inks or other media). Each such embellishment is unique. The hand-embellishment shown in any product image or description is therefore illustrative only — the exact hand-embellishment on the Product you receive will be unique to that piece.

 

Please Note: where a product listing states that the proof number shown in the thumbnail is not necessarily the one available, this means you will receive the proof currently held in stock. If you have a preference for a specific proof number, please contact us before ordering.

4. Limited Editions and Artist’s Proofs

4.1 Limited Edition Prints

Each limited edition print is produced in a fixed, strictly limited number as stated on the product page. Once an edition is sold out, no further prints of that edition will be produced. Prints are numbered and signed by the artist and are recorded in the artist’s edition register.

4.2 Artist’s Proof Prints

Artist’s Proof prints (‘AP’s’) form part of the artist’s own retained allocation outside the numbered edition. They are produced in very small numbers (the number available will be stated on the product page) and may be hand-embellished by the artist. Artist’s Proofs are signed and supplied with a Certificate of Authenticity.

Artist’s Proofs are distinct from the numbered edition and are priced accordingly. They are not substitutes for numbered prints.

4.3 Certificates of Authenticity

Artist’s Proofs and Limited Edition Prints are supplied with a Certificate of Authenticity signed by the artist. The certificate will state the title, edition number (where applicable), paper specification, and the artist’s signature.

If your Certificate of Authenticity is lost or damaged, you may request a replacement. Replacement certificates are issued at the artist’s discretion and may be subject to an administration fee.

4.4 Greeting Cards

Greeting cards are standard retail printed goods. They are not part of any numbered edition, are not signed, are not supplied with certificates of authenticity, and may be produced in unlimited quantities. They do not have the same collectible or scarcity characteristics as limited edition artworks.

5. Pricing and Payment

5.1 Prices

All prices are shown in pounds sterling (GBP) and are inclusive of VAT where applicable. Prices do not include delivery charges, which are shown separately at checkout.

We reserve the right to change prices at any time. Price changes will not affect orders for which we have already sent a Confirmation Email (as defined in Clause 6.3 below).

If, despite our best efforts, a Product is incorrectly priced and the error is obvious and could reasonably have been recognised by you as a mispricing, we reserve the right to cancel your order and refund any payment made.

5.2 Payment Methods

Payment must be made in full at the time of placing your order. We accept payment by credit and debit card (Visa, Mastercard, Maestro, American Express), Apple Pay, Google Pay, and buy-now-pay-later services (Klarna and Clearpay).

Where you choose a buy-now-pay-later service, your agreement for those payment arrangements is directly with the relevant third-party provider and is subject to their terms and conditions. We are not responsible for any issues arising from your use of those services.

5.3 International Buyers

If you are purchasing from outside the United Kingdom, prices shown on our Website are exclusive of any customs duties, import VAT, or handling charges that may be levied by your country’s customs authorities. You are solely responsible for any such charges. We are unable to predict or control these charges and recommend that you check with your local customs authority before ordering.

5.4 Discount Codes

From time to time we may issue discount codes. Discount codes are subject to the specific terms stated when issued, and may be time-limited, single-use, or restricted to specific Products or categories. We reserve the right to withdraw or amend any discount code at any time.

6. . Ordering and Contract Formation

6.1 Placing an Order

To purchase a Product, add it to your cart and complete the online checkout process. You will have the opportunity to review and amend your order before submitting it. Please check your order carefully before submitting, including the Product description, frame option, quantity, and delivery address.

6.2 Our Right to Decline

Your order constitutes an offer to purchase. We reserve the right to decline any order at any time and for any reason, including where a Product is out of stock, where a pricing error has occurred, or where we are unable to verify your payment details. We will notify you promptly if we cannot accept your order and will refund any payment taken.

6.3 Contract Formation

A binding contract between you and us is formed only when we send you a written order confirmation by email (‘Confirmation Email’). We will assign an order number to your order, which will appear in your Confirmation Email. Please quote this number in any correspondence with us about your order.

6.4 Pre-Orders

Some Products may be offered on a pre-order basis, where the Product is not yet ready to dispatch at the time of ordering. Where a pre-order is available, the estimated dispatch date will be stated on the product page. Estimated dispatch dates are indicative only and are not guaranteed. If we are unable to dispatch within a reasonable time of the estimated date, we will notify you and offer you the option to cancel and receive a full refund.

7. Delivery

7.1 Delivery Estimates

Delivery times are estimates and are not guaranteed. We will use reasonable endeavours to dispatch your order promptly following receipt of payment and order confirmation. We will notify you by email when your order has been dispatched.

We are not liable for delays caused by circumstances outside our reasonable control, including postal or courier delays, adverse weather conditions, or customs processing times. See Clause 14 (Force Majeure) for further details.

7.2 Delivery of Framed Works

Framed works are carefully packed for transit. We have successfully shipped framed works containing glass nationally and internationally since 2005. However, we strongly recommend that you ensure adequate insurance cover is in place for high-value orders.

7.3 Risk and Ownership

Risk in the Products passes to you on delivery. Title (ownership) in the Products passes to you only upon receipt of full payment.

7.4 Failed Delivery

If a delivery attempt is made and you are not available, the courier or postal service will leave instructions for collection or re-delivery. If a Product is returned to us as undeliverable due to an incorrect address or failure to collect, we may charge for re-delivery. If you choose not to have the Product re-delivered, we will refund the Product price but not the original delivery charge.

7.5 International Delivery

We ship internationally. For international orders, delivery times will be longer and will depend on the destination country and customs processing. You are responsible for any customs duties, import taxes, or handling charges imposed by your country. We are unable to mark international shipments as ‘gifts’ or understate their value.

8. Damaged, Faulty or Lost Items

8.1 Damaged on Arrival

If a Product arrives damaged, you must notify us within 48 hours of delivery by contacting us at hello@kapulewis.com. You must retain all original packaging and provide us with clear photographic evidence of the damage to both the Product and the outer packaging before we can assess your claim. Failure to notify us within this timeframe or to retain the packaging may affect your ability to make a claim.

8.2 Faulty Products

If a Product develops a fault that is not the result of damage in transit, normal wear and tear, or mishandling, please contact us as soon as reasonably practicable. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

8.3 Lost in Transit

If your order has not arrived within a reasonable time of the estimated delivery date, please contact us at hello@kapulewis.com and we will investigate with the relevant carrier. We will not treat a shipment as lost until a reasonable investigation period has elapsed (typically 15 working days for UK orders and 30 working days for international orders from the dispatch date).

9. Returns, Cancellations and Consumer Rights

9.1 Your Statutory Right to Cancel

If you are a consumer purchasing through our Website, you have the right to cancel your order without giving any reason within 14 calendar days of the day on which you (or a person you nominate) receive the Product. This right is provided under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise your right to cancel, you must inform us of your decision to cancel before the 14-day period expires, either by using the model cancellation form below or by contacting us at hello@kapulewis.com or by post to FutureSmartMedia Limited, 4 Denbigh Close, London, W11 2QH.

9.2 Exceptions to the Right to Cancel

The right to cancel does not apply to:

  • Products that have been clearly personalised or made to your specific requirements

  • Sealed Products which are not suitable for return once unsealed, where the seal has been broken after delivery

 

Please note that while framed products are not standard ‘custom made’ items, where a specific frame option has been selected and prepared for your order, this may affect your cancellation rights. Please contact us if you are unsure before ordering.

9.3 Returning Cancelled Items

If you cancel your order, you must return the Product to us within 14 days of notifying us of your cancellation. You are responsible for the cost of returning the Product unless the Product is faulty or not as described. Products must be returned in their original condition and packaging. We strongly recommend using a tracked and insured service for returns, as we cannot be responsible for Products lost or damaged in return transit.

We will issue your refund (including the standard outward delivery charge, but not any additional delivery charges you chose) within 14 days of receiving the returned Product back or of receiving evidence that you have sent it back, whichever is earlier. Refunds will be made to your original payment method.

9.4 Faulty or Misdescribed Goods

If a Product is faulty, not as described, or does not conform to the contract, you have rights under the Consumer Rights Act 2015, including the right to a repair, replacement, or refund. Please contact us as soon as possible.

10. Intellectual Property and Copyright

10.1 Artist’s Copyright

All copyright and other intellectual property rights in the artworks, illustrations, visual poems, and designs sold through this Website remain exclusively with Katharine Lewis (Kapu Lewis). The sale of a Product does not transfer any copyright or other intellectual property rights in the underlying artwork to you.

10.2 What You May and May Not Do

By purchasing a Product you acquire ownership of the physical item only. You may not, without our prior written consent:

  • Reproduce, copy, scan, photograph, or digitise the artwork for any commercial purpose

  • Use the artwork (or any reproduction of it) in advertising, marketing, merchandise, or any other commercial context

  • Create derivative works based on the artwork

  • Sub-license, sell, or otherwise transfer any reproduction rights to a third party

 

Personal, non-commercial use (such as photographing your purchased artwork for personal social media posts, provided appropriate credit is given to Kapu Lewis) is permitted.

10.3 Credit

We kindly ask that whenever you share or display your purchased artwork publicly — whether in person, online, or in print — you credit the work to Kapu Lewis and reference www.kapulewis.com where practicable.

11. Resale and Artist’s Resale Right

11.1 Resale of Artworks

You are free to resell your purchased Product privately, through a gallery, dealer, or auction house. We make no representation or guarantee regarding the future resale value, investment potential, or financial return of any Product. References to edition size, rarity, or scarcity are descriptive of the nature of the work and are not statements about investment value. Artworks are sold primarily as artistic works to be enjoyed, not as financial investments.

11.2 Artist’s Resale Right

Where a resale involves a qualifying resale under the Artist’s Resale Right Regulations 2006 (as amended), the artist may be entitled to a royalty on the resale price. This obligation falls on the art market professional involved in the resale (such as an auction house or gallery) and not on the private buyer. We recommend that you seek independent advice if you are involved in a commercial resale of any of our artworks.

12. Our Liability

12.1 Limitation of Liability

Subject to Clause 12.2, our total liability to you in connection with any order is limited to the price paid for the relevant Product(s) in that order.

We will not be liable for any indirect, consequential, special, or punitive loss arising from your purchase or use of our Products, including any loss of profits, loss of revenue, or loss of anticipated savings.

12.2 Losses We Do Not Exclude

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be limited or excluded by law

  • Your rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation

 

12.3 Consumer Rights

As a consumer, you have legal rights under the Consumer Rights Act 2015 and other applicable legislation. These Terms do not affect those rights. Advice about your rights is available from Citizens’ Advice (www.citizensadvice.org.uk).

13. Accessibility

We are committed to making our Website and the purchasing process as accessible as possible. If you require any assistance when ordering, or if you have any accessibility requirements, please contact us at hello@kapulewis.com and we will do our best to assist you.

We make our Products available in framed and unframed options to accommodate different needs. If you have any specific requirements relating to packaging, delivery, or presentation of your order, please let us know.

14. Force Majeure

We will not be liable for any delay in, or failure to perform, our obligations under these Terms to the extent that such delay or failure is caused by circumstances beyond our reasonable control, including (without limitation) fire, flood, storm, earthquake, pandemic, epidemic, postal or courier failures, industrial action, governmental action, or failure of telecommunications networks.

If such an event occurs, we will notify you as soon as reasonably practicable and will endeavour to resume performance as soon as the circumstances allow. If the delay or non-performance continues for more than 30 days, either party may cancel the affected order and we will refund any payments made for Products not yet dispatched.

15. Complaints

If you have a complaint about any Product or about our service, we would like to hear from you. Please contact us in the first instance at hello@kapulewis.com or via our contact form at www.kapulewis.com/contact.

We will acknowledge your complaint within two working days and will aim to resolve it within ten working days. If we are unable to resolve your complaint to your satisfaction, you may refer it in accordance with our Conduct, Concerns and Complaints Policy.

You may also refer a dispute to an approved alternative dispute resolution (ADR) scheme in accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.

16. General

16.1 Entire Agreement

These Terms, together with our Website Terms of Use, our Privacy and Cookie Policy, and our Conduct, Concerns and Complaints Policy, constitute the entire agreement between you and us in relation to the purchase of Products through this Website.

16.2 Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated ‘Last updated’ date. Changes will not affect any order for which we have already sent a Confirmation Email.

16.3 Severability

If any provision of these Terms is found by a court to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

16.4 No Third-Party Rights

These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999.

16.5 Transfer

We may transfer our rights and obligations under these Terms to another organisation, provided this does not adversely affect your rights. You may not transfer your rights under these Terms without our prior written consent.

16.6 Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction over any dispute or claim arising from these Terms or any order placed under them. If you are a consumer resident in Scotland, Northern Ireland, or another country, you retain the right to bring proceedings in the courts of your country of residence.
